Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“you” or “Customer”) and 3TAI LLC, doing business as Big Shot Data (“we,” “us,” or “our”). By accessing or using https://bigshotdata.com (the “Site”) or purchasing our competitive intelligence reports (the “Services”), you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use our Site or Services. We reserve the right to update these Terms at any time. Material changes will be communicated by updating the effective date above and, where appropriate, by email notice.

Big Shot Data provides AI-powered competitive intelligence reports for small businesses. Our Services include:

• Free Competitive Snapshot: A complimentary, one-page competitive positioning analysis generated from publicly available data and your company website.
• Standard Intelligence Report ($149 USD): A comprehensive, five-chapter competitive intelligence report including demographics analysis, competitor assessment, market positioning, and a revenue playbook. Reports are generated using artificial intelligence and delivered digitally.

Reports are generated using data from public sources including government databases (U.S. Census Bureau, Bureau of Labor Statistics, TTB), web research services, and the company website URL you provide. Report content is AI-generated and should be used as one input among many in your business decision-making.

You must be at least 18 years old and capable of forming a binding contract to use our Services. By using our Services, you represent and warrant that you meet these requirements.

To access your paid report, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials and not share them with others
• Notify us immediately if you suspect unauthorized access to your account
• Accept responsibility for all activity that occurs under your account

• The Standard Intelligence Report is priced at $149.00 USD as a one-time payment. All prices are displayed in U.S. dollars. This is introductory pricing and is available while the offer lasts; we reserve the right to change pricing at any time without notice for future purchases.
• Payments are processed securely through Stripe. We accept Visa, Mastercard, American Express, and Discover.
• By providing payment information, you authorize us to charge the stated amount through Stripe.
• You are responsible for any applicable taxes, which will be added to the price where required by law.
• We do not store your credit card information. All payment data is handled by Stripe in accordance with PCI DSS standards.

After purchase, you will be prompted to complete a brief business questionnaire to customize your report. Your report will be delivered digitally within approximately two hours of payment. You will receive an email notification when your report is ready to view in your dashboard.

Delivery times are approximate. While we strive for timely delivery, occasional delays may occur due to high demand or technical factors. If your report has not been delivered within 24 hours, contact us at reports@bigshotdata.com.

9.1 Our Intellectual Property

The Site, including its design, code, branding, logos, and the report generation methodology, are the intellectual property of 3TAI LLC. You may not copy, modify, distribute, or reverse engineer any part of the Site or our underlying technology.

9.2 Your Report License

Upon payment, you receive a non-exclusive, non-transferable license to use your purchased report for your internal business purposes. You may share your report within your organization. You may not resell, redistribute, or publicly publish the report in full without our written consent.

9.3 Your Content

You retain ownership of the information you provide to us (business details, questionnaire responses). By submitting this information, you grant us a limited license to use it solely to generate your report and improve our Services.

You agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to our systems, accounts, or data
• Interfere with or disrupt the operation of the Services
• Use automated tools (bots, scrapers) to access the Services without our written permission
• Resell or commercially redistribute report content without authorization
• Submit URLs to websites you do not own or have authority over

We reserve the right to suspend or terminate your access if you violate these terms.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

WE DO NOT WARRANT THAT: (A) THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE; (B) REPORT CONTENT WILL BE ACCURATE, COMPLETE, OR CURRENT; (C) THE RESULTS OBTAINED FROM THE SERVICES WILL BE RELIABLE; OR (D) ANY DEFECTS IN THE SERVICES WILL BE CORRECTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, 3TAI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless 3TAI LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content or information you submit through the Services.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Travis County, Texas. You consent to the personal jurisdiction of such courts.

We may suspend or terminate your access to the Services at any time for any reason, including violation of these Terms. Upon termination:

• Your license to use the Services and access your dashboard will end
• Previously purchased reports will remain accessible for 30 days following termination to allow you to download copies
• Provisions that by their nature should survive termination (including Sections 9, 11, 12, 13, and 14) will survive

You may close your account at any time by emailing reports@bigshotdata.com.

• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and 3TAI LLC regarding the Services.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force.
• Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights freely.
• Force Majeure: We shall not be liable for delays or failures caused by circumstances beyond our reasonable control.
